The Procedural Law Governing Facts and Evidence in International Human Rights Proceedings

  • Categories: Law

This book provides a comparative assessment of the procedural law governing facts and evidence with references to over 900 judgments and decisions of the European and the Inter-American Court of Human Rights as well as the UN Human Rights Committee. It identifies underlying principles which govern the procedural law of these international human rights institutions. Based on the premise of a contextualized procedural law governing facts and evidence, the book analyzes where current approaches lack a foundation in the contextualization premise and offers solutions for recurring procedural problems relating to questions of subsidiarity in fact-finding, burden and standard of proof, as well as the admissibility and evaluation of evidence.

The expulsion of the Moriscos from Spain (1609-1614) represents an important episode of ethnic, political and religious cleansing which affected about 300,000 persons. The controversial measure was legimitized by an ideology of religious and political unity that served to defend the expulsion of them all, crypto-Muslims and sincere converts to Christianity alike. The first part focuses on the decision to expel the Moriscos, its historical context and the role of such institutions as the Vatican and the religious orders, and nations such as France, Italy, the Dutch Republic, Morocco and the Ottoman Empire. The second part studies the aftermath of the expulsion, the forced migrations, settlement and Diaspora of the Moriscos, comparing their vicissitudes with that of the Jewish conversos. Contributors are Youssef El Alaoui, Rafael Benítez Sánchez Blanco, Luis Fernando Bernabé Pons, Paulo Broggio, Miguel Ángel de Bunes Ibarra, Antonio Feros, Mercedes García-Arenal, Jorge Gil Herrera,Tijana Krstić, Sakina Missoum, Natalia Muchnik, Stefania Pastore, Juan Ignacio Pulido Serrano, James B. This book highlights the unique history and cultural context of retranslation in Turkey, offering readers a survey of the diverse range of fields, disciplines, and genres in which retranslation has assumed a central position. Further, it addresses largely unexplored issues such as retranslation in Ottoman literature, paratextual positioning and marketing of retranslations, legal retranslation, and retranslation in music. As such, it makes a valuable contribution to the growing body of research on retranslation by placing special emphasis on non-literary translation, making the role of retranslation particularly visible in connection with politics and philosophy in Turkey.

Breeding Bin Ladens

A look into the state of Islam in Europe and the threat posed by excluding moderate Muslims in Western society. While American leaders wage war with extremists in the Middle East, they are ignoring a greater threat closer to home. In Breeding Bin Ladens, Zachary Shore asserts that the growing ambivalence of Europe’s Muslims poses risks to national identities, international security, and the transatlantic alliance. Europe’s failure to integrate its Muslim millions and America’s battered image in the Muslim world have left too many Western Muslims easy prey for violent dogmas. Until America and Europe adopt new strategies, Shore argues, Europe will increasingly become the incubation grou...
