Partindo do enquadramento da função jurisdicional exercida através do processo arbitral, a designada função arbitral, o estudo centra-se na análise da autonomia processual das partes e da discricionariedade processual do tribunal arbitral, incluindo os respetivos pressupostos e limites, no âmbito das quais se permite uma conformação processual limitada pelas exigências do processo equitativo.
