This report contains a number of papers which examine the national laws of European countries regarding the treatment and protection of people belonging to national minorities who live in states outside the borders of their country of origin. This study was undertaken in order to establish whether such laws are compatible with the principles of international law and Council of Europe standards, following the adoption by Hungary in 2001 of an Act which provides benefits and assistance to those of Hungarian origin or identity who live in neighbouring countries.
The Academy is an institution for the study and teaching of public and private international law and related subjects. Its purpose is to encourage a thorough and impartial examination of the problems arising from international relations in the field of law. The courses deal with the theoretical and practical aspects of the subject, including legislation and case law. All courses at the Academy are, in principle, published in the language in which they were delivered in the "Collected Courses of the" "Hague Academy of International Law." La Commission européenne pour la démocratie par le droit (la Commission de Venise) est un organisme consultatif en matière de droit constitutionnel, créé au sein du Conseil de l'Europe. Elle est composée d'experts indépendants d'Etats membres du Conseil de l'Europe, ainsi que d'Etats non membres. A présent, quelque quarante Etats participent aux travaux de la commission. La commission se met à la disposition des pays qui demandent sa coopération dans le processus de réformes constitutionnelles. Elle peut aussi entreprendre des études générales et élaborer des projets de loi et de traité.
Ce premier volume d'une série d'ouvrages sur les questions en matière de minorités offre un aperçu global et critique des problèmes, avec un accent particulier sur les événements de l'après-guerre froide. Les différents chapitres traitent des questions comme celle de la protection juridique des minorités dans le cadre du Conseil de l'Europe, des Nations unies, de l'OSCE et de l'Union européenne. L'auteur examine attentivement la question de l'autodétermination des minorités, notamment dans la jurisprudence de la Cour européenne des Droits de l'Homme, du Conseil de l'Europe et du Comité des droits de l'homme des Nations unies.
