Coroners' Recommendations and the Promise of Saved Lives

  • Categories: Law

This is the first empirical law book to investigate coroners’ recommendations, and the extent of their impact and implementation. Based on an extensive study, the book analyses over 2000 New Zealand Coroners’ recommendations and includes more than 100 interviews and over 40 surveys, as well as Coroner’s Court findings and litigation from Canada, England, Ireland, Australia and Scotland. This timely book is an overdue investigation of the highly debated questions: do coroners’ recommendations save lives and how often are they implemented?

The essays in this volume reflect the exciting new directions in which legal history in the settler colonies of the British Empire has developed. The contributors show how local life and culture in selected settlements influenced, and was influenced by, the ideology of the rule of law that accompanied the British colonial project. Exploring themes of legal translation, local understandings, judicial biography, and "law at the boundaries," they examine the legal cultures of dominions in Canada, Australia, and New Zealand to provide a contextual and comparative account of the "incomplete implementation of the British constitution" in these colonies.

Nga Tini Whetu

Nga Tini Whetu Navigating Maori Futures brings together twenty-five papers Mason Durie has presented at national and international conferences between 2004 and 2010. It discusses Maori moving towards a future involving new technologies, alliances, economies and levels of achievement and being equipped to respond to the changes in a way that enables Maori to prosper and live in a changing world as Maori. This book builds on and extends Mason Duries thinking in Nga Kahui Pou Launching Maori Futures, published previously, and develops his thoughts on Maori positioning to best respond to unfolding events and trends. The papers discuss issues such as indigenous resilience and transformation, Maori potential and achievement, the Treaty of Waitangi and the national and global situation, health care and ethics, and future scenarios for Maori social and economic development and sustainability.

The Political Philosophy of Property Rights

  • Categories: Law

This mongraph reasserts the primacy of property in political theorising. Arguing that the determination of property rights is part of the justification of the state, MacDonald notes the failure of much current philosophising to take account of this role when setting out the normative arguments for legitimate political authority. MacDonald criticises current philosophical definitions of property as a bundle-of-rights, arguing that for normative purposes, property is a right of exclusion in rem. Thereby MacDonald escapes the interminable moral and legal arguments over property - such as questions of Lockean labour theory, self-ownership, and indigenous historical injustice - that have dominated recent political philosophy. Instead, the book focuses on the failure of libertarian and liberal egalitarian theories of justice to produce a plausible account of both legitimate political authority's right to regulate property, and the principles upon which that regulation ought to occur. The book will be of interest to scholars of political philosophy and theory, especially those engaged in the contemporary ideas of justice, legitimacy and the justification of the state.
