O presente livro tem como tema e objetivo a análise da incapacidade eleitoral ativa nas hipóteses de suspensão dos direitos políticos por condenação criminal e atos de improbidade administrativa, no Brasil, e sua compatibilidade com o Estado de Direito Democrático. A partir de revisão bibliográfica, buscam-se as premissas fundamentais sobre o Estado de Direito e a participação do povo no Poder, sobre a importância do voto popular em um regime democrático e sobre o próprio processo de ampliação do sufrágio em favor das pessoas (do restrito ao universal). A partir dessas premissas, busca-se verificar se é incompatível com o Estado de Direito Democrático a interpretação que limita o voto (capacidade eleitoral ativa) dos adultos capazes cujos direitos políticos são temporariamente suspensos nas hipóteses previstas na Constituição de 1988.
