Sinopsis : Dilatarbelakangi realitas pertanggung jawaban pidana terhadap korporasi dan pengurusnya. Apabila korporasi dimintai pertanggungjawaban maka pengurusnya tidak dimintai pertanggungjawaban. Begitupun sebaliknya. Padahal, baik korporasi dan pengurusnya menikmati keuntungan atau hasil tindak pidana secara bersama-sama yang sekaligus membuktikan bahwa adanya pengetahuan, kehendak, dan akibat yang diketahui dan dikehendaki kedua subjek hukum tersebut. Melihat potensi keduanya dapat dimintai pertanggungjawaban pidana maka penulis menggagas double responsibility theory atau teori tanggungjawab ganda dimana satu perbuatan dapat dimintai 2 (dua) pertanggungjawaban, yakni korporasi dan pengurus yang melakukan dapat dimintai pertanggungjawaban secara bersama-sama. Melalui buku ini diharapkan terdapat kesamaan cara pandang atau perspektif dalam menilai pertanggungjawaban terhadap korporasi dan pengurusnya.
BUDAYA HUKUM DALAM MASYARAKAT PLURALISTIK
