Direito, enquanto reflexo econômico e social, deve fornecer meios para antever e solucionar problemas, detendo, também, caráter preventivo. Assim, considerando que no Brasil quase 90% das empresas são familiares, sendo que estas possuem demandas próprias, o Protocolo Familiar constitui-se uma imprescindível ferramenta. Isso porque é um instituto jurídico que reúne normas e códigos de conduta para a manutenção e coordenação das riquezas geradas por famílias, especialmente aquelas que se encontram no comando de sociedades. Porém, a utilização desse instrumento deve estar cercada de cuidados, exigindo compatibilização com preceitos legais, tanto de ordem familiar, sucessória, contratual, como societária. A presente obra analisa a legalidade, eficácia e as implicações societárias do Protocolo Familiar, registrando os principais efeitos sobre sociedades limitadas e anônimas.
