Innovation and Transition in Law: Experiences and Theoretical Settings
This book features a discussion on the modernisation of law and legal change, focusing on the key concepts of innovation" and "transition". These concepts both appear to be relevant and poorly defined in contemporary legal science. A critical reflection on the heuristic value of these categories seems appropriate, particularly considering their dyadic value. While innovation is increasingly appearing in the present day as being the category in which one looks at the modernisation of law, the concept of transition also seems to be the privileged place of occurrence for such dynamics. This group of Italian and Brazilian scholars contributing to this volume intends to investigate such problems through an interdisciplinary prism. It includes points of view both internal to legal studies - such as the history of law, theory of law, constitutional law, private law and commercial law - and external, such as political philosophy and history of justice and political institutions.

The Poulterers’ Case (1611)
Every student of criminal law knows for a fact that the Poulterers' Case (1611) launched modern criminal conspiracy. This decision laid the first stone of the principle that an agreement to commit a crime is also a crime. However, besides what the law reports say, little is known about the facts of the case. This edition of the testimonies collected by the Star Chamber intends to fill this gap. El hospital de pobres estudiantes del estudio general de Valencia (1540-1847)
La fundación de hospitales para estudiantes pobres, tuvo por objeto la atención médica y farmacéutica al referido colectivo. En general, las referencias sobre este tipo de instituciones son escasas.En 1540 fue fundado con el título de cofradía, el Hospital de Pobres Estudiantes del Estudio General de Valencia, cuya monografía pretende contribuir al estudio de la historia de las universidades, en concreto a la referida a la Universitat de València en su función asistencial. Se describe y analiza la vida de dicho hospital en sus aspectos organizativo, asistencial, económico, patrimonial, fiscalizador y contable, actas de las Juntas de Hacienda, escrituras públicas, claustros de catedráticos, prioratos y Juntas de Patronato de la Ciudad de Valencia.
Isidore of Seville and the Liber Iudiciorum
Isidore of Seville and the “Liber Iudiciorum” establishes a novel framework for re-interpreting the Liber Iudiciorum (LI), the law-code issued in Toledo by the Visigothic king Recceswinth (649/653-672) in 654. The LI was a manifestation of a vibrant dialectical situation, particularly between two networks of authority, Isidore-Seville and Toledo-Agali, a defining characteristic of the discourse coloring the fabric of writing in Hispania, c. 600-660. To more fully imagine the meaning, significance and purposes of the LI, this book elicits this cooperative competition through a series of four case-studies on writing in the period. In addition to offering an alternative historiography for the LI, this book expands the corpus of “Visigothic Literature” and introduces what the author refers to as “Gothstalgie.” See inside the book.
Constantino de la Fuente (San Clemente, 1502–Seville, 1560)
During the first half of the sixteenth century the Spanish Inquisition fought "Lutheranism" in a benign way, but as time passed the power struggle between those that favoured reform and the detractors intensified, until persecution became relentless under the mandate of Inquisitor General Fernando de Valdés. The power struggle did not catch Constantino by surprise, but the tables turned faster than he had expected. On 1 August 1558 Constantino preached his last sermon in the cathedral of Seville; fifteen days later he was imprisoned. Constantino's evangelising zeal is evident in all his works, but the core of his theology can be found in Beatus Vir, where he deals with the doctrines of sin and pardon, free grace, providence, predestination, and the relationship between faith and works. In his exposition of Psalm 1, Constantino does not resort to human philosophies but associates the spiritual fall of humanity with ugliness. In his exhortation to the reader, he states: "we shall plainly see the repulsiveness of that which seems so good in the eyes of insane men, and the beauty and greatness of that which the Divine Word has promised and assured those who turn to its counsel."
