Economic Sanctions in Criminal Justice

Economic Sanctions in Criminal Justice

"Justice is expensive. So is injustice. These kinds of judgments are usually made in terms of money, and an economic focus makes sense in the context of criminal law and procedure, since money has long played a role in how society deals with unlawful behavior. These economic sanctions, the court-imposed financial obligations that follow a criminal conviction, are useful because they apply a metric that is understood by everyone. The notion of using money as a means of resolving criminal and civil problems goes back almost four thousand years, to the Code of Hammurabi (Van Ness, 1990), and there are several Biblical injunctions regarding payment after crimes. In the Middle Ages, victims were entitled to compensation for injuries (adjusted for their rank in society), and by the twelfth century, the king was entitled to a fee for administering the system (Klein, 1997)"--

After the Crime

Analyzing the findings of 20 studies, involving more than 5,000 people, this book explores the decision making process of the crime victim in the immediate aftermath of victimization. Using a broad range of innovative research techniques, the authors assess the effects of rape, robbery, burglary, and theft on individuals from diverse nationalities and ethnic backgrounds. This work will be of value to people who work directly with crime victims, and to researchers who are interested in the process of decision making under stressful circumstances.

"The book achieves its goal of encouraging the reader to think broadly about how the consequences of violent victimization can be measured, understood, and prevented. The authors also achieve their goal of emphasizing the need for multiple research methods and multiple theoretical perspectives for understanding the effects and implications of violent crime. This expanded book version of a special issue of the journal Violence and Victims analyzes the social and cultural factors that influence violent behaviors. The editors and contributors discuss the latest findings and gaps in current research and theory in order to gain valid theoretical bases to investigate and control violent behaviors. Topics include cross-cultural studies of interpersonal violence, gender variations in violence across societies, a cross-national analysis of violence by and against women, and regional differences in homicide rates in the United States. Researchers, academics, and other professionals in sociology, criminology, and psychology, as well as students in these fields will find this book a welcome addition to their collection.

The Trial Process

As noted in the Preface to Volume 1 in this series, the goal of Perspectives in Law and Psychology is to provide a forum for books aimed at systemati cally interfacing the two disciplines. Toward this end, Volume 1 pre sented a collection of original writings focused on the criminal justice system that grew out of a conference held at the University of Nebraska at Lincoln. Because that volume was based on conference proceedings, however, an attempt was not made to provide thorough coverage of all law-psychology issues in the criminal justice system; rather, it highlight ed a select few issues that were currently being investigated by some of the outstanding people in the field. This volume differs substantially from the first in that it attempts to bring together those psycholegal scholars who are doing the major re search on the trial process today and provides broad coverage of critical research on the trial. Thus, the chapters not only provide an extensive review of existing literature in this field but also present new contribu tions by these scholars.
