Resolving Land and Energy Conflicts studies energy in the landscape across gas and oil, wind, transmission and nuclear waste disposal. The authors are particularly interested in the conflicts that emerge from specific sites and proposals as well as how this unique land use plays out in terms of conflict and resolution across scales and jurisdictions while touching on broader issues of policy and values. Resolving Land and Energy Conflicts briefly explains the general context around the energy type; the impacts and conflicts that have arisen given this context; the role laws, rules and jurisdictions play in mitigating, resolving or creating more conflict; and the ways in which communication, collaboration and conflict resolution have been or could be used to ameliorate the conflicts that inevitably arise.
This book offers a vision for the third generation of environmental law designed to enhance its ability to protect our environment. The book presents two core proposals, an Environmental Legacy Act to preserve a defined environmental legacy for future generations and an Environmental Competition Statute to spark movement to new clean technologies. The first proposal would require, for the first time, that the federal government define an environmental legacy that it must preserve for future generations. The second would establish a market competition to maximize environmental protection. The balance of the book provides complementary proposals and analysis. The first generation of environmental law sought broad protection of health and the environment in a fairly fragmented way. The second sought to enhance environmental law's efficiency through cost-benefit analysis and market mechanisms. These proposals seek to create a broader, more creative approach to solving environmental problems.
Climate change presents the United States, and the world, with regulatory problems of a magnitude, complexity and scope unseen before. The United States, however, particularly after the mid-term elections of 2010, lacks the political will necessary to aggressively address climate change. Most current books focus on climate change. Ending Dirty Energy Policy argues that the US will not adequately address climate change until it transforms its fossil fuel energy policy. Yet there are signs that the country will support the transformation of its century-old energy policy from one that is dependent on fossil fuels to a low-carbon energy portfolio. A transformative energy policy that favors energy efficiency and renewable resources can occur only after the US has abandoned the traditional fossil fuel energy policy, has redesigned regulatory systems to open new markets and promoted competition among new energy providers, and has stimulated private-sector commercial and venture capital investment in energy innovations that can be brought to commercial scale and marketability.
Presented in nontechnical terms, this book offers a unique and powerful conceptual framework for analysis of energy technologies (standard and alternative) in terms of their respective dollar costs, environmental costs, and national security costs. Energy technologies examined include coal, nuclear, oil, natural gas, solar, wind, geothermal, hydropower, biomass and biogas, energy conservation and efficiency, ocean power, hydrogen, electric power and transmission, and transportation.
