Doing Justice, Preventing Crime

  • Categories: Law

Punishment policies and practices in the United States today are unprincipled, chaotic, and much too often unjust. The financial costs are enormous. The moral cost is greater: countless individual injustices, mass incarceration, the world's highest imprisonment rate, extreme disparities, especially affecting members of racial and ethnic minority groups, high rates of wrongful conviction, assembly line case processing, and a general absence of respectful consideration of offenders' interests, circumstances, and needs. In Doing Justice, Preventing Crime, Michael Tonry lays normative and empirical foundations for building new, more just, and more effective systems of sentencing and punishment i...

Contributors to the book are drawn from leading academics and practitioners in the field, drawing upon the best expertise available. Running through the book is a concern with a range of key current issues such as addressing the diversity of offenders and creating effective links with other criminal justice agencies, and it includes perspectives from both probation service staff and from offenders and victims. This book is an essential text for practitioners, trainees and students of probation and those studying it as part of a wider criminology or criminal justice course.

The Partisan Politics of Law and Order

  • Categories: Law

"Why have some Western democracies experienced a substantial turn toward tougher law and order policies whereas others have not changed their policies to a similar extent? This book shows that an important part of the explanation has to do with political parties and how they compete. It provides empirical evidence on three channels through which partisan politics matter: First, political parties in general, and issue owners in particular, move their programmatic stance toward the more repressive pole if they are challenged by right-wing populist parties or if they are pressured by a major competitor in a two-party system. In contrast, when strong liberal parties exist in a party system and a...

Welsh prisoners in the prison estate

  • Categories: Law

The Committee undertook this inquiry to address concerns about the imprisonment of Welsh prisoners outside Wales. At present there are only four prisons in Wales, all in the South, and there is little provision for juveniles and no prisons for women. The overcrowding means that Welsh prisoners have a reduced chance of serving their sentence near home and reduces the chances of successful resettlement on release. The Committee believe there should be new prison places in North Wales, separate provision for young offenders and a new approach to women prisoners along the lines suggested by Baroness Corston. The report also address concerns about support services for mental illness amongst prisoners, the amount of Welsh language provision and education services.

In this book, Liz Turner argues that survey methods have gained an unwarranted and unhealthy level of dominance when it comes to understanding how the public views the criminal justice system. The focus on measuring public confidence in criminal justice by researchers, politicians and criminal justice agencies has tended to prioritise the production of quantitative representations of general opinions, at the expense of more specific, qualitative or deliberative approaches. This has occurred not due to any inherent methodological superiority of survey-based approaches, but due to the congruence of the survey-based, general measure of opinion with the prevailing neoliberal political tendency t...
