Consentimento do titular do bem jurídico
O consentimento do titular do bem jurídico-penal é estudado no contexto de tensão entre as ideias ilustradas e as crescentes demandas criminalizantes. O estudo pressupõe a análise do paradigma vigente sobre o objeto de proteção penal e o reconhecimento de que o titular do bem jurídico afetado pela conduta incriminada é relegado a um segundo plano, neutralizado. Tomando a autonomia de vontade individual como dimensão da dignidade humana, o estudo propõe a releitura do consentimento como meio de exercício da autodeterminação por parte do titular do bem jurídico afetado. A ênfase desse aspecto da dignidade/vontade do sujeito atribui ao consentimento função redutora de incriminação, conciliando novas demandas sociais com o ideário ilustrado.
