Transplanting Commercial Law Reform
The first sustained analysis examining legal transplantation into East Asia, this volume examines the prospects for transplanting a 'rule of law' that will attract and sustain international trade and investment in this economically dynamic region. The book develops both a general model that explains how legal transplantation shapes legal development in the region, whilst developing theoretical insights into the political, economic and legal discourses guiding commercial law reforms in Vietnam. For the first time, this book develops a research methodology specifically designed to investigate law reform in developing East Asia. Getting Organized in Vietnam
From the late 1950s in the north, to the 1970s until the mid- 1980s in the south, there was little room or opportunity to form non-state voluntary organizations and associations in Vietnam. With few exceptions, only those established by the Communist Party and other state agencies were permitted. The picture has changed considerably since doi moi. From proactive self-help associations for the disabled to mass, semi-state or non-governmental organizations, the Vietnamese people are getting together to voice their collective and specific interests vis a vis the state. The process of getting together, voicing ideas, acting in concert, and attempting to influence policy in some cases is ongoing and in constant flux. This book presents original case studies of the gamut of organizations in Vietnam today and analyses their relationships with umbrella state organizations which are themselves evolving. Media Fortunes, Changing Times

Human Rights in Asia
Human Rights in Asia considers how human rights are viewed and implemented in Asia. It covers not just civil and political rights, but also social, economic and cultural rights. This study discusses the problems arising from the fact that ideas of human rights have evolved in Western liberal democracies and examines how far such values are compatible with Asian values and applicable in Asian contexts. Core chapters on France and the USA provide a benchmark on how human rights have emerged and how they are applied and implemented in a civil law and a common law jurisdiction. These are then followed by twelve chapters on the major countries of East Asia plus India, each of which follows a common template to consider the context of the legal system in each country, black letter law, legal discussions and debates and key current issues concerning human rights in each jurisdiction.
Towards Realizing an ASEAN Community. A Brief Report on the ASEAN Community Roundtable
ASEAN has produced a plan of action on ASEAN Economic Integration, which is annexed to the Bali Concord II. To kick-start the ASEAN Economic Community (AEC), the plan of action provides numerous policy recommendations to be implemented over the next 1 to 2 years. At the track-two level, research institutes/think-tanks such as ASEAN-ISIS, ISEAS and CSIS (Jakarta) have contributed concept papers on the AEC and the ASEAN Security Community (ASC). This Roundtable provided the opportunity for scholars and experts on ASEAN to "brain-storm" in a more comprehensive and integrated manner, the different ideas and proposals underpinning the process of community building that ASEAN is embarking upon. This report reflects the conclusions that emerged from the ASEAN Community Roundtable.
