Kira sözleşmesi, kiracıya bedel karşılığı kiralananı olağan ölçüler içinde kullanma hakkı veren, kiraya verenin kira konusunun kullanımını kiracıya bırakmayı, kiracının da bunun karşılığında kira bedelini ödemeyi taahhüt ettiği bir sözleşmedir. Kira sözleşmesinin konusunu genellikle, maddî nitelikte taşınır ya da taşınmaz eşya oluşturur. Her türlü maddî nitelikte eşya kiraya verilebilir. Kiralananın kullanılması ile kira bedelinin değişimi konusunda tarafların karşılıklı anlaşması ile sözleşme kurulmuş olur. Tarafların ehliyeti, sözleşmenin kurulması, temsil ve şekil gibi hususlar 6098 sayılı Türk Borçlar Kanununun ve 4712 sayılı Türk Medenî Kanununun genel hükümlerine tabidir. Bu çalışmada, kira sözleşmesinde tarafların hak ve yükümlülükleri, temerrüt, ayıplı ifa gibi borca aykırılık halleri, bunların sonuçları, taşınmaz kiralarında tahliye ve tüm bu konularda 6098 sayılı Yeni Türk Borçlar Kanunu ile getirilen yenilik ve değişiklikler incelenmiştir.
