Environmental Refugees

Environmental Refugees

Climate change is primarily associated with its physical outcomes, such as extreme weather events, rising sea levels, and desertification. However, these climatic impacts do not only pose a threat to the environment, natural habitat, and biodiversity, but also to society. Environmental migration - as one social aftermath of climate change - is the subject of this thesis. The emergence of environmental refugees is heatedly debated in the media, among policymakers, and in academic writing of various disciplines. The book takes that debate seriously. It does not put the existence of environmental refugees a priori to its analysis, but scrutinizes the different notions critically. The thesis pro...

The book addresses the question of whether the currently available instruments of international environmental and international humanitarian law are applicable to climate conflicts. It clarifies the different pathways leading from climate change to conflict and offers an analysis of international environmental law embedded within the international doctrine of state responsibility. It goes on to discuss whether climate change amounts to an issue covered by Art. 2.4 UN Charter – the prohibition of the use of force. It then considers the possible application of international humanitarian law to climate conflicts. The book also offers a definition of the term “climate conflict”, drawing on legal as well as peace and conflict studies.

It examines diversity in all its forms, investigating how best to develop an international arbitral order that is not just tolerant of diversity, but that sustains and promotes diversity in concert with harmonized practices.

The Moral Standing of the State in International Politics

The Moral Standing of the State in International Politics

Kant’s moral and political philosophy has been important in developing ethical thinking in international relations. This study argues that his theory of the state is crucially important for understanding the moral agency of the state as it is discussed in contemporary debates. For Kant, it is argued that the state has not only duties but also, controversially, inalienable rights that ground its relationship to its citizens and to other states. Most importantly, the state – regardless of its governmental form or factual behaviour – has a right to exist as a state. The Kantian account provided, therefore, explores not only the moral agency but also the moral standing of the state, examining the status of different kinds of states in world politics and expectations towards their ethical behaviour. Every state has a moral standing that must be respected in a morally imperfect world gradually transforming towards the ideal condition of perpetual peace.
