"The law on the protection of foreign investments is situated at the crossroads of international law and diplomacy in the context of a globalized economy. It is therefore not surprising that investment law has undergone fundamental changes in the last decade. The exponential growth of arbitration cases has illustrated a number of complex legal and political issues that have called into question the efficiency and legitimacy of investor State dispute settlement (ISDS). Thus, even for experts in the field it is challenging to keep track with the rapid and fundamental changes of what is often described as one of the most dynamic fields of international law. Against this background, the present ...

The Multi-level Governance of Space Mining

  • Categories: Law

Aerospace Law and Policy Series, Volume 24 Space mining holds the potential to revolutionize the space sector, but whether this revolution will be for good or for worse depends on how it will be governed. Under the right framework, space resource activities can enable a new era of prosperous and sustainable space exploration. But with the wrong rules (or lack thereof), they have the potential to destabilize the peaceful and cooperative uses of space. This book provides an in-depth analysis of how the systemic nature of international law, existing provisions of international space law and a growing number of national legislations are shaping the multi-level governance of space mining, includi...

Pioneers of Space Law

  • Categories: Law

International space law is less than 50 years old. Although the work on the codification of space law started in the late 1950s, the Outer Space Treaty was only adopted in January 1967. However, much earlier than that, even as early as 1932, the first ideas about legal rules for human activities in outer space were being considered. Very little is known about these early drafts and proposals, and the pioneering work of early scholars in the field remains relatively unknown. This volume seeks to redress this by analysing the biographies and contributions to international space law of eleven such early "pioneers”, whose ground-breaking and original work helped to develop the field in important ways. The collection starts in the 1930's with the Czech author Vladimir Mandl, and dwells at length on the 1950's, the early time of space flight. The section on each "pioneer" is written by different members of the International Institute of Space Law, making this a lively, fascinating and unique collection of essays, of interest to the whole community of space lawyers.

This book analyses the adequacy of Mongolia’s legal system for foreign investment protection by conducting a multi-level assessment of international investment treaties, domestic legislation of the host State, and investor-State contracts from an international comparative perspective. The investigation distinguishes between three legal dimensions, each of which offers both substantive legal guarantees for the protection of investments in the host State and provisions for the settlement of investment disputes by arbitration. In the first dimension of Public International Law (PIL), Mongolia is bound by international investment treaties, which offer investors an international law setting. In...

The Geostationary Ring: Practice and Law addresses numerous physical aspects of this highly sought-after orbit which serves as the backbone for international satellite communications and analyses the evolution of its use, coordination and related disputes along with sovereignty claims over segments of the Geostationary Orbit. The author, Martha Mejía-Kaiser, discusses the increasing population of this orbital region with operational spacecraft, its pollution with man-made space debris, and the upcoming active space removal by external systems. Based on empirical data, the author analyses in unprecedented detail a measurable State practice in the efforts of keeping this orbital region operational, and addresses key legal questions with regard to the benefit and interests of all nations, equitable access and its economic and rationale use. Outer Space in Society, Politics and Law

  • Categories: Law

Spaceflight is a rational undertaking, yet full of emotions. It is a dream of mankind and a multi-billion industry likewise. It is subject to a distinct branch of law – and moreover part of modern pop culture. In short: spaceflight is fascinating. “Outer Space in society, politics and law” is an inter-disciplinary approach to the understanding of modern space law. Technical, cultural and historical aspects lay the foundation for a sound comprehension why space law norms have been established and what they mean in practice. The reader will realize the impact space and spaceflight have on society – from Stonehenge to climate change. A new approach to presenting space law: comprehensive and illustrative. “We live in a society absolutely dependent on science and technology and yet have cleverly arranged things so that almost no one understands science and technology. That's a clear prescription for disaster.” Carl Sagan
