A fonte de inspiração desse trabalho vem da observação de que a felicidade passa a compor os debates jurídicos internacionais, precisando, no Brasil, de uma investigação a respeito dos importantes fenômenos que giram em torno desse fato. Pretende-se investigar duas questões: uma geral e, se confirmada esta, uma específica. A questão geral se refere à existência de um direito amplo à felicidade. Visa a identificar se há referências históricas de apelo normativo a essa aspiração humana tão básica e, havendo, qual o momento em que elas se estabeleceram e em quais bases foram construídas. Há um direito natural à felicidade? Mais do que um elemento moral e ético que conduziu civilizações, a felicidade seria um bem apto a ser constitucionalmente protegido e, consequentemente, digno da atenção dos sistemas normativos por meio de leis e políticas públicas? Assim sendo, poderiam, os tribunais, definir seus contornos conceituais de modo a reduzir o uso populista, demagogo ou abusivo do direito à felicidade por parte das autoridades responsáveis pela sua concretização?
