"This handbook is intended to enable national judges in all types of tribunals in both civil law and common law jurisdictions to identify environmental issues coming before them and to be aware of the range of options available to them in interpreting and applying the law. It seeks to provide judges with a practical guide to basic environmental issues that are likely to arise in litigation. It includes information on international and comparative environmental law and references to relevant cases."--P. iii.
Judges play a critical role in the development, enforcement and compliance with environmental law. To showcase the role of the judiciary in upholding the rule of law, IUCN organized a "Judiciary Day" at its 2004 World Conservation Congress in Bangkok. This publication contains papers and speeches covering some of the cutting-edge themes that were discussed. It is hoped that these proceedings will enable a wide community of readers to better understand the crucial role of the judiciary in achieving the goals of sustainable development and nature conservation.
Biodiversity is in accelerated decline and urgent action is needed. In 2020, the Strategic Plan for Biodiversity ended, and none of its Aichi Targets were met. Despite the legally disappointing situation on a global level, the role of national courts in adjudicating climate change litigation is showing potential for effective mitigation and adaptation, and judges have become key actors in linking internationally agreed goals with tangible national commitments to mitigate climate change. Can this pursuit of globally agreed goals at a local level be transposed and lead a similar trend for biodiversity governance? This edited collection gives readers an overview of the shape and reach of biodiv...
This publication contains four papers on different legal issues of interest to developing countries. The papers were researched and written by four Carl Duisberg Gesellscaft (CDG) Fellows who came to Germany from Bangladesh, Venezuela, Nigeria and China to study under the host leadership of the IUCN Environmental Law Centre. Subjects chosen by these Fellows vary widely, and cover ISO 14001, access to environmental justice in Latin America, patents and plant resources-related knowledge, and law and policy of the European Union on the reduction of greenhouse gas emissions and their significance to China.
Despite all the talk of sustainability, there has not been enough action to halt or reverse the impacts of climate change. Decades after the Rio Earth Summit and despite the many policies and commitments to move toward sustainable development, there continues to be a serious implementation gap. Implementing Sustainable Development focuses on the challenges of turning international commitments and policy promises into local action. Through global examples and cases, the authors examine not only the core principles, but also successful and failed efforts to address the social, environmental, and economic dimensions of sustainable development. They systematically guide readers through the techn...
