The degree of development reached by cooperatives of different sectors throughout the world, which among others led to the UN declaring 2012 as the International Year of Cooperatives, needs to be accompanied by a similar development of corresponding legislation. To this end, a better knowledge of cooperative law from the comparative point of view, as has already been established for other types of enterprises, becomes of great importance. This book strives to fill this gap, and is divided into four parts. The first part offers an analytic and conceptual framework with which to understand, study and assess cooperative law from a transnational and comparative perspective. The second part includes several chapters dealing with attempts to harmonize cooperative laws. Pourquoi et comment le droit de la preuve doit-il être unifié dans les États membres de l'Organisation pour l'Harmonisation en Afrique du Droit des Affaires (OHADA) ? L'harmonisation du droit de la preuve se justifie par la disparité des normes probatoires aux sources plurielles voire concurrentes, et la mixité du système probatoire partagé entre la preuve libre et la preuve légale. Une harmonisation du droit de la preuve permettrait, en outre, de moderniser la matière et de l'adapter aux réalités africaines. Toutefois, le droit de la preuve s'accommode mal d'une intégration au droit des affaires. A cet égard, aussi nécessaire que paraît l'émergence d'un droit uniforme de la preuve, son élaboration dans le cadre de l'OHADA appelle des précautions dans la méthode et dans le contenu.
