Law and Property in Algeria

"In spite of its privileged place on the African continent, in the Muslim world and in the Middle East and North Africa region, Algeria remains poorly known, and the works relating to contemporary Algerian society published outside of Algeria are rare. This book seeks to contribute to our understanding of Algerian society today, through its relationships to property and to law. Beyond this, the objective is to propose, in a comparative perspective proper to anthropology, new theoretical and methodological perspectives by which to apprehend the anthropology of law in a Muslim context. Algeria, as a post-colonial and post-Socialist State, whose population is overwhelmingly Muslim, proves to be a particularly interesting case to study"--

Crime and Compensation in North Africa

As the 21st century began, Algeria, Morocco, and North Sudan launched some much-publicised “reconciliation” policies, or, in the case of North Sudan, “pacification” policies. Algeria, following its Clemency policy (1995) and Civil Concord Law (1999), held a referendum in 2005 and subsequently implemented the measures of its Charter for Peace and National Reconciliation. This charter is Algeria’s latest policy aimed at settling the accounts of a murderous decade (1990s) between the state and armed Islamic groups. In Morocco, an arbitration committee was set up in 1999, followed by the Equity and Reconciliation Commission in 2004, to turn the page on the “Years of Lead”—a perio...

Truth, Intentionality and Evidence

This book provides an anthropological exploration of the ways in which crime is perceived and defined, focusing on notions of truth, intentionality, and evidence. The chapters contain rich ethnographic case studies drawn from work in the Middle East, Africa, India, Mexico and Europe. A variety of instances are discussed, from court proceedings, police reports and newspapers to moments of conflict resolution and reconciliation. Through analysis of this material, the authors reflect on how perception of an act as a crime can differ and how the definition of crime may not be shared by all societies. The approach takes into consideration local standards as well as social, legal and contextual constraints.

Anthropology of Law in Muslim Sudan analyses the hybridity of law systems and the plurality of legal practices in rural and urban contexts of contemporary Sudan, shedding light on the complex relation between Islam and society. It is the outcome of the international research program ANDROMAQUE (Anthropologie du Droit dans les Mondes Musulmans Africains et Asiatiques), funded by the French ANR (Agence National de la Recherche) between 2011 and 2014. Crossing two disciplinary perspectives, anthropology and law, the present volume contains original fieldwork data on contemporary urban and rural Sudan. Focusing on two major domains, land property and courts, several case studies demonstrate the ...

Sovereignty in Exile

Sovereignty in Exile explores sovereignty and state power through the case of a liberation movement that set out to make itself into a state. The Sahrawi Arab Democratic Republic (SADR) was founded by the Polisario Front in the wake of Spain's abandonment of its former colony, the disputed Western Sahara. Morocco laid claim to the same territory, and the conflict has locked Polisario and Morocco in a political stalemate that has lasted forty years. Complicating the situation is the fact that Polisario conducts its day-to-day operations in refugee camps near Tindouf, in Algeria, which house most of the Sahrawi exile community. SADR (a partially recognized state) and Polisario (Western Sahara'...
