El Tomo II del Tratado de Derecho de Aguas, Perspectiva internacional del derecho de aguas para el siglo XXI es resultado de la labor conjunta del Grupo de Investigación en Derecho del Medio Ambiente de la Universidad Externado de Colombia y diversos grupos de investigación extranjeros que unieron esfuerzos para analizar cuestiones estructurales del derecho de aguas general, al tiempo que se identifican los principales temas que actualmente se encuentran en discusión desde la perspectiva de varios ordenamientos jurídicos internacionales, entre ellos la propiedad de las aguas, la planificación, el ordenamiento y política de las aguas, el derecho internacional de las aguas, el estudio jurídico de los fenómenos hidrológicos extremos, la fiscalidad del agua, así como la gestión y gobernanza de los recursos hídricos.
No es exagerado afirmar que el derecho de aguas adquirió vida propia respecto de las antiguas categorías del derecho administrativo, en particular la del dominio público, que hoy se muestra desueta y poco actual para responder a las necesidades de protección de los recursos hídricos, pero que se resiste a desaparecer. Parece que la ambientalización del derecho de aguas ha ido en detrimento de su demanialización. Sin embargo, no se puede negar la importante relación entre el derecho de aguas y el de los bienes públicos.
