Human Rights and Personal Self-defense in International Law

  • Categories: Law

While an abundance of literature covers the right of states to defend themselves against external aggression, this is the first book dedicated to the right to personal self-defense in international law. Dr. Hessbruegge sets out in careful detail the strict requirements that human rights impose on defensive force by law enforcement authorities, especially police killings in self-defense. The book also discusses the exceptional application of the right to personal self-defense in military-led operations, notably to contain violent civilians who do not directly participate in hostilities. The author establishes that international law gives individuals the right to forcibly resist human rights violations that pose a serious risk of significant and irreparable harm. At the same time, he calls into question prevailing state practice, which fails to recognize any collective right to organized armed resistance even when it constitutes the last resort to defend against genocide or other mass atrocities.

Partnerships between the public and private sectors are an increasingly accepted method to deal with pressing global issues, such as those relating to health. Partnerships, comprised of states and international organizations (public sector) and companies, non-governmental organizations, research institutes and philanthropic foundations (private sector), are forming to respond to pressing global health issues. These partnerships are managing activities that are normally regarded to be within the domain of states and international organizations, such as providing access to preventative and treatment measures for certain diseases, or improving health infrastructure within certain states to bett...

As the global population ages, disability demographics are shifting. Societal transformation and global health inequities have changed who is likely to reach old age, who is likely to live with disability, and the relationship between aging and disability in various socio-cultural and geopolitical contexts. The Aging–Disability Nexus breaks new ground by bringing gerontology and disability studies into dialogue with each other through a variety of empirical, conceptual, and pedagogical approaches. Contributors explore the tensions that shape the way disability and aging are understood, experienced, and responded to at both individual and systemic levels, while avoiding the common tendency to conflate these overlapping elements and map them onto a normative, faulty notion of the human life trajectory. This perceptive work analyzes the distinction between aging with a disability and aging into disability, and reveals how multiple identities, socio-economic forces, culture, and community give form to our experiences.

This collection of essays explores cultural narratives of care in the contexts of ageing and illness. It includes both text-based and practice-based contributions by leading and emerging scholars in humanistic studies of ageing. The authors consider care not only in film (feature and documentary) and literature (novel, short story, children’s picturebook) but also in the fields of theatre performance, photography and music. The collection has a broad geographical scope, with case studies and primary texts from Europe and North America but also from Hong Kong, Japan, Australia, Argentina and Mexico. The volume asks what care, autonomy and dependence may mean and how these may be inflected by social and cultural specificities. Ultimately, it invites us to reflect on our relations to others as we face the global and local challenges of care in ageing societies.

Indigenous Peoples' Status in the International Legal System

  • Categories: Law

While many have explored the law surrounding the rights of indigenous peoples through an examination of all relevant instruments and institutions, this book is based on the premise that one can obtain an in depth knowledge of the indigenous rights regime by simply knowing the answer to two questions: What is meant by 'peoples' and 'equality' under international law? From Terra Nullius to International Legal Subjects and Possessors of Land - Indigenous Peoples' Status in the International Legal System offers a new and profound insight into the international indigenous rights discourse. This volume articulates that the understanding of 'peoples' is paramount to the question of whether indigeno...
