International Airline Alliances : EC Competition Law/US Antitrust Law and International Air Transport

  • Categories: Law

This new study takes a keen look at the problems facing the international community due to conflicts arising from applications of varying competition laws by different competition authorities to international airline alliances. As a result of privatisation, deregulation, liberalisation and globalisation, international air carriers form alliances with one another in order to cope with growing competition in the international air transport market. This book clearly provides an introduction to the background to and origin of airline alliances, different models of alliances and the related anti-competitive practices resulting from existing international airline alliances. The potential anti-comp...

First published in 2000, this volume examines the role of industry representation in the EU in the case of the air transport industry. Air transport has contributed to areas including member state interdependence, national defence in foreign policy considerations and national identity in terms of ‘flag carrier’ airlines. Dinos Kyrou looks at specific case studies concerning aspects of integration of the air transport sector within the European Union. These case studies – an examination of a European Commission Proposal for a Council Directive and the attempt by the Commission to formulate a Proposal for a Council Regulation – are stages in the process of policy formulation which are aimed at enhancing the liberalisation which was completed de jure in 1992. In both cases, the increasing prominence of the Competition Directorate of the European Commission (DGIV) has been evident. Kyrou’s question is whether this reflects a restoration or a creation of pride and self.

Prior to liberalization, there was little scope for predatory behaviour in the aviation market. However, following deregulation, new entrants sought to compete with entrenched incumbents. Low-cost carriers (LCCs) gained significant market share, which in turn provoked many different kinds of defensive response. Having put pressure on established carriers, low-cost airlines are themselves feeling the pressure of competition from new operators. While it is normal and natural for airlines to react to competition - modifying their services, the ways in which they offer them and their prices - when does aggressive commercial behaviour go too far and become predation? This book considers what exac...

This title was first published in 2003. The events of 11 September 2001 defy modern economic theory when addressed in aviation terms. Economic theory would suggest that, once the impact of such events are a thing of the past, and economies are restored to their status quo ante, a rise in the gross domestic product of States to earlier levels would almost inevitably result in increased consumption. This in turn would mean that the demand for air travel would rise to earlier proportions and consumption in terms of air transport services would be restored to normalcy. However, the September attacks on United States' property introduced a unique characteristic through the fear factor that direct...
