O princípio da relatividade dos contratos é um velho conhecido. Funcionou como um dogma por mais de um século, impedindo que seus efeitos alcançassem terceiros. A admissão da eficácia dos contratos em relação a terceiros veio com o entendimento de que a oponibilidade e os efeitos relativos podem coexistir, representando duas faces dos efeitos do contrato. Não apenas os direitos reais são oponíveis a todos, mas também todos os elementos jurídicos (fato, ato, direito subjetivo, situação jurídica) podem ter eficácia indireta. Após essa constatação, é crucial aplicar e solucionar a problemática entre oponibilidade e cognoscibilidade dos elementos jurídicos. As controvérsias emergem em grande número e se resolvem de formas diversas, dependendo da publicação dos elementos jurídicos, da existência de um sistema legal de publicidade e da dotação de publicidade natural dos elementos jurídicos.
