National Sovereignty and International Organizations
This book deals with the question of national sovereignty and States' participation in International Organizations, whether traditional or supranational ones. Although there has been much discussion on the problems posed by the transference of sovereignty, this volume provides an original insight in that transfer of state sovereignty is approached as a dynamic process that can be divided into three different phases. Part one, called `the initial phase', focuses on the examination of the domestic legal basis for the transfer of state sovereignty. Part two, `the transfer phase', investigates how the process of transfer evolves within the core of two International Organizations: the United Nations and the European Communities. Part three, `the post-transfer phase', analyses the States' responses to the effects and consequences of the transfer of sovereignty.

This book is the first legal treatment of tied aid and examines in detail the compatibility of tied aid with EU and WTO law. The workings of the aid projects and aid procurement systems of donor countries granting bilateral aid are fully examined through case studies from the UK, Italy, the EU and the US. Tied aid refers to aid granted to developing countries on condition that goods and services for the aid-financed projects are purchased from the donor country only. Hanns Ullrich, this highly renowned legal scholar, has had a tremendous influence on legal research and the development of the law in the fields of both Technology and Competition. His expertise dates back to the late 1970s and early 1980s, when he served as a member of the research staff at the Max Planck Institute for Intellectual Property in Munich. In 1985, he became professor of law at the "Universität der Bundeswehr", Munich, and finally, in 2000, professor at the european University Institute, florence. He has acted as visiting professor at a number of Universities around the worldincluding, in particular, the College of Europe, Bruges. The authors of the contributions in this book feel greatly indebted to Hanns Ullrich. Much earlier than others, he recognised and explained that, in the absence of pressure from competition, intellectual property will not be able to fulfil its mission of enhancing innovation. In concentrating on the fields of interest of this eminent scholar, the contributions address a number of the most burning issues of the regulation of intellectual property, competition law and, of course, the application of competition law to IP-related cases.
