The open access publication of this book has been published with the support of the Swiss National Science Foundation. In WTO Law and Trade Policy Reform for Low-Carbon Technology Diffusion, Zaker Ahmad puts a spotlight on the crucial importance of dismantling market barriers and offering incentives to improve clean technology access and diffusion across borders. To that end, the author argues for a synergistic co-development of the international trade and climate legal regimes. Two case studies – one on carbon pricing, another on official export credit support – place the theoretical arguments in a practical trade policy setting. The emerging doctrine and principle of Common Concern of Humankind serves as the key theoretical and structural foundation of the work. A useful read for anyone interested in an effective role of trade law and policy to facilitate climate action.

Secret Treaties and Other International Agreements

In Secret Treaties and Other International Agreements, Peter C. Lundy explores the relationship between formal treaties under international law and documents of lesser status, commonly known as memorandums of understanding. The book critically examines the gaps in diplomatic policy, with a particular focus on the Australian Government’s casual approach to these non-treaty documents. Featuring original copies of the historic Five Eyes Agreement between the British Government and the United States, the book offers a unique perspective on significant international relations. Lundy delves into the consequences of relying on such agreements, notably highlighting the atomic bomb tests at Maralinga in South Australia. Beyond identifying these issues, the book proposes methods to address the inconsistencies in how the Australian Government handles non-treaty documents. It also compares the approaches of other nations, including the United States, the United Kingdom, and the European Community, offering solutions to the challenges Australia has faced in the past.

The World Trade Organisation plays the primary role in regulating international trade in goods, services and intellectual property. Traditionally, international trade law and regulation has been analysed primarily from the trade-in-goods perspective. Services are becoming an important competence for the WTO. The institutional, legal and regulatory influence of the General Agreement on Trade in Services (GATS) on domestic economic policymaking is attracting increasing attention in the academic and policymaking literature. The growing importance of services trade to the global economy makes the application of the GATS to trade in services an important concern of international economic policy. ...

The Europeanization of National Foreign Policies towards Latin America

Who shapes the European Union’s policy towards Latin America? How has this EU policy modified individual member states’ relations with the region? This book provides a comparative account of seven member states’ bilateral links with Latin America since 1945, in the context of their EU membership and based on the concept of ‘Europeanization’. It illustrates how and why the main architects of this EU policy have been Spain and Germany. In contrast, Poland, Sweden and Ireland, which had little previous interaction with Latin America, have developed their current relations with that region virtually as a result of their EU membership. The United Kingdom and France lie in the middle: they have been influential in certain policy-areas and key periods in history, while they have adapted to what is done at the EU level in others. Practitioners, established academic experts as well emerging scholars in the field bring to be bear a novel combination of pioneering research and cutting edge conceptual analysis on this important but neglected area of the EU’s foreign relations.

The Law and Practice of Global ICT Standardization

  • Categories: Law

This book presents a first comprehensive effort to explore the mechanics and fundamentals of global ICT standardization. It offers a comprehensive study of legal rules governing ICT standardization; systematically analyses governance and institutional features of some most prominent Standards Development Organizations; and presents qualitative empirical evidence on implementation of these rules in practice. By evaluating legal and procedural rules in light of current practices and tendencies in the industry, the book explores various options available for disciplining ICT standardization from the viewpoint of the applicable legislation, judiciary, and internal governance rules of Standards Development Organizations and offers practical solutions on how to increase the legitimacy of ICT standards. Adding to the previous theoretical approach to the field of standardization from historical, legal and political science perspective, this book applies theoretical considerations to unexplored scenarios, offering a holistic picture of ICT standardization and providing a novel contribution to the field.
