Identifying Exclusionary Abuses by Dominant Undertakings under EU Competition Law

  • Categories: Law

Under Article 102 TFEU, dominant firms are allowed to compete, but only to the extent their market behaviour does not constitute an abuse. Needless to say, the wording of the article neither explains what an abusive restriction of competition is nor how such a practice can be identified. Rather than developing a one-size-fits-all test applicable to all forms of market behaviour by dominant firms, the European Court of Justice (ECJ) and the General Court (ex; Court of First Instance) have set out a system of tests for separate categories of conduct. Drawing on the full range of the EU Courts’ relevant case law, this very useful book analyses the conditions that must be fulfilled for a broad...

Research Handbook on Abuse of Dominance and Monopolization

  • Categories: Law

This Research Handbook offers a comprehensive and state-of-the-art collection on the competition law (antitrust) prohibition of abuse of a dominant position and monopolization. It draws from the long and influential traditions of leading jurisdictions such as the European Union and the United States to analyse applicable rules and policy in these jurisdictions. It also takes a comparative approach to identify common threads and differences.

Antitrust in Data Driven Markets & Legal Framework for Influencers, Native Advertising and Control over the Use of AI in Marketing

  • Categories: Law

This book gathers contributions from a broad range of jurisdictions, written by practitioners and academics alike, and offers an unparalleled comparative view of key issues in competition law, intellectual property and unfair competition law, with a specific focus on the use of personal data. The first part focuses on the role of competition law in shaping the digital economy. It discusses the use of personal data, the market power of platforms, the assessment of free services, and more broadly the responsibility of dominant companies in the smooth functioning of the digital economy. In turn, the second part sheds light on how the conduct of influencers, native advertising and the use of AI ...

The intersection between Competition law and intellectual property has always been a subject matter of controversy because of the very nature of the two subject areas. On the one hand, competition law seeks to protect the interest of traders and consumers by way of abuse of monopoly power on the part of an enterprise or an individual, and on the other hand, the grant of an intellectual property right to a person, automatically excludes other persons from making use of the property on which the right has been vested.

For those who didn't buy the first edition, welcome aboard. For those who did buy the first edition, welcome back, and thanks for making the second edition possible. For those who bought the first edition and are standing in the book store wondering whether to buy the second, what's in it for you? Well, for one thing, it's smaller. (No, no! Don't leave!) I tried to make the first edition a kind of master reference for antiviral protection. That meant I included a lot of stuff that I thought might possibly be helpful, even if I had some doubts about it. This time I've tried to be a little more selective. I've added a little more material to Chapter 4 (Computer Opera tions and Viral Operations) dealing with the question of computer vi ruses infecting data files and the new "macro" viruses. I've added two new sections to Chapter 7 (The Virus and Society). One looks at the increasing problem of false alarms while the other looks at the ethics of virus writing and exchange.

Volume One in a new series, this book covers Norwegian women's writing over the last 150 years, setting literary developments against the background of the emergence and growth of the women's movement in Norway. The work is divided chronologically into three sections: the period up to 1913, when the universal suffrage was granted; the period from 1913 to 1960, a time of stagnation in the women's movement, with little involvement in contemporary political, social and economic debates; and the period from 1960 to the present day, which has seen an increasing participation of women in public life. Chapters on individual authors concentrate on the images of the women portrayed and investigate th...

Prominent Scandinavian authors from the end of the 19th century struggled with the classical themes of myth and religion, and the modern concepts of Freud and Darwin. The reconciliation of these counterpoints in the work of Norway's Henrik Ibsen, Sweden's August Stringbberg and Denmark's J P Jacobsen, forms the core of this analysis. Incorporating Diderot's definition of theatricality in painting, this study shows the tension between the image and a concomitant distrust of its reality in three of Ibsen's plays: A Doll's House; Ghosts; and The Wild Duck. Investigating the mythical patterns beneath the text, Osterud suggests that Ibsen's naturalist drama is two-fold: a clash between the sacred...
