A presente obra busca analisar se os limites do humor político poderiam ser explicados a partir de uma teoria de direitos fundamentais. Nesse sentido ela parte da ideia de que expressões humorísticas são uma forma de expressão artística e, portanto, encontram-se resguardadas por direitos fundamentais constitucionalmente garantidos. Mas no ordenamento constitucional brasileiro não existem apenas direitos fundamentais de liberdade, existem também outras categorias que podem, em tese, estabelecer restrições ao exercício dessas liberdades, e é nesse ponto de intersecção que pode estar a solução para o problema dos "Limites do humor". Com esse objetivo em mente, na presente obra é realizado um breve retrospecto do humor político no Brasil e um estudo da estrutura dos direitos fundamentais, a fim de se tentar chegar a uma resposta que se mostre constitucionalmente adequada.
