European Criminal Justice and Policy
Reviewing European policy with respect to different phases in the criminal justice chain, the contributions in this book range from looking into the extension of criminalization in the sphere of trafficking in human beings and labor exploitation, to the operability of cross-border execution of sentences involving deprivation of liberty. Most contributions look into the need to develop a conceptual framework to support future policy making, pointing to the lack thereof with respect to liability of legal persons, ne bis in idem as an EU principle, cross-border effect of disqualifications, and cooperation with private security actors. One essay looks into the public expenditure in different phases of the criminal justice chain, based on a case study on the public expenditure of Belgian drug policy. This book marks the 20th anniversary of the Department of Criminology of the National Institute of Criminalistics and Criminology (NICC). On the occasion of this anniversary, a series of research seminars were organised, during which NICC researchers, practitioners and international experts engaged in a dialogue on several key research themes. They discussed the future of the Department of Criminology and put the work of the NICC into perspective, both nationally and internationally. The results of these exchanges are bundled in this book.
Substance Use Recovery among Persons with a Migration Background and Ethnic Minorities
This dissertation provides a comprehensive understanding of substance use recovery and recovery capital among the diverse group of persons with a migration background and ethnic minorities (MEM). The doctoral study offers a nuanced and detailed examination of the lived experiences of MEM with substance use problems from a combined local (Flanders, Belgium) and international perspective. By exploring recovery and recovery capital among MEM in an increasingly participatory manner, the dissertation uncovers which personal, social and community resources may be mobilised to support recovery. It unveils how important barriers to recovery, such as multiple intersecting forms of stigma, may be overcome. Finally, a co-creative case study offers a specific deepening of how the continuum of care for substance use problems may be tailored to persons with an Islamic migration background. This dissertation aims to inspire researchers, policymakers, and (future) practitioners to look beyond existing reference, policy, and practice frameworks and to open up possibilities for more inclusive recovery-supportive environments.
EU Criminal Justice, Financial & Economic Crime
This fifth volume of the Governance of Security (GofS) Research Paper series addresses a wide variety of topical issues focusing on European criminal justice and financial and economic crime. The first cluster of articles is concerned with European criminal justice matters particularly relating to EU mutual recognition, such as: conceptualization, unwanted effects in the context of prisoner transfer and sentence execution, impact for cross-border gathering and use of forensic expert evidence, and interrogational fairness standards. A second cluster of articles addresses the subjects of financial and economic crime, ranging from informal economy (among street children) to formal/informal economy (vulnerability of the hotel and catering industry to crime) and white collar crime phenomena like (transnational) environmental crime and corruption. A final cluster groups together a variety of selected topical issues, including juvenile offending and mental disorders, desistance theories, and sexually transmitted infections.
Legitimacy and Trust in Criminal Law, Policy and Justice
Whereas previous studies of legitimacy and trust have mostly dealt with procedural justice and the police, this book focuses on other crucial understudied aspects of legitimacy within criminal law, policy and criminal justice. The chapters expand and develop current criminological, legal and socio-legal research by addressing conceptions of legitimacy linked to criminal law norms, criminalisation and sanctioning; by examining EU legal and policy aspects of the phenomenon; and by exploring some specific court-related issues of legitimacy and trust, hitherto neglected. With contributions from across the EU, this interdisciplinary collection presents a valuable discussion on the importance of trust in legal institutions of modern democracies and suggests ideas for future research in this area to challenge ways of thinking about legitimacy.
