Through further technological development and increased globalization, conducting busines abroad has become easier, especially for Small and Medium Enterprises (SME). However, the legal issues associated with international commerce have not lessened in complexity, including the role of non-state rules. The book provides a comprehensive analysis of non-state rules in international commercial contracts. Non-state rules have legal authority in the national and international sphere, but the key question is how this legal authority can be understood and established. To answer this question this book examines first what non-state rules are and how their legal authority can be measured, it then ana...

Introduction to EU Law - Revision Guide

  • Categories: Law

The real reason for the emergence of this book is that it is hard to find resources to explain complex issues of the EU Law in plain language, which makes it very difficult for those taking an interest, in particular law students. Moreover, many years of teaching experience in this subject and seeing students experience difficulties is the key driver behind this book. This book does not repeat material that is available in many textbooks that are in print. Rather, it endeavours to present every topic in plain language and concludes every chapter with a fictitious explanatory sample case. In other words, it is an introduction to the subject of EU Law, the objective of which is to explain the ...

Introduction to Criminal Law - Revision Guide

  • Categories: Law

Over the past forty years, the approach to legal disputes in England and Wales has experienced some important changes. In many instances, mediation, with its objective of resolving disputes, is favoured over the traditional and adversarial procedure of litigation. Intriguingly, the perspectives of mediators on the practice of family mediation are relatively unexplored territory. This book with its focus on family mediation seeks to reduce this gap by supplementing the existing literature. It will put forward the family mediators’ opinions and my recommendations on how family mediation can be improved from the perspective of models. It aims to contribute, through the practitioners’ lens, ...

(2) Is there still merit in a multilateral approach to transnational commercial law and ICDR, despite the closing of borders, the rise of protectionism, and the disruption of global supply chains? (3) What reforms and in...

The system of international criminal justice was established in response to gross human rights violations committed during World War II. Despite its development over the past seven decades, challenges and critiques remain unresolved or have subsequently emerged, particularly in the context of the International Criminal Court (ICC). Key issues include amnesties, immunities, controversial acquittals, non-cooperation, interpretative fragmentation, and cultural clashes. Criticism emerged as a reaction to the perception of impunity and the system’s underachievement. It is important to reflect on the extent to which such challenges are inherent to the system and whether they can be overcome. What is the state of international criminal justice today? What impact have these challenges had on the system’s integrity, currency, and credibility? To what extent can we prevent or remedy them? This volume brings together major contributions to the 8th AIDP Symposium for Young Penalists which was organised by the AIDP Young Penalists Committee and convened on 10 and 11 June 2021 in telematic mode, hosted by the Faculty of Law of Maastricht University.
