This book presents the XXII Congress of APDIO – IO 2022 which is the 22nd edition of the regular meeting of the Portuguese Association of Operational Research (APDIO). Conceptual Modeling
This book constitutes the refereed proceedings of the 42nd International Conference on Conceptual Modeling, ER 2023, held in Lisbon, Portugal, during November 6-9, 2023. The 21 full papers were carefully reviewed and selected from 121 submissions. Additionally, the book contains 4 keynote speeches and 3 tutorials, and one invited paper corresponding to one of the keynote speeches. The papers cover a broad spectrum of classical and modern topics on conceptual modeling, including research and practice in the theories of concepts and ontologies, techniques for transforming conceptual models into effective implementations, and methods and tools for developing and communicating conceptual models.
DEZ ARGUMENTOS PARA REVISÃO DO TEMA 342 DO STF E A SUA TOTAL INAPLICABILIDADE NAS AQUISIÇÕES FEITAS POR ENTES FEDERADOS
O livro tem como foco central verificar a pertinência jurídica do Tema 342 elaborado pelo Supremo Tribunal Federal, que não reconhece o exercício do direito constitucional da imunidade tributária do ICMS e/ou do IPI nas aquisições ou compras feitas por pessoas jurídicas imunes, com ênfase, pelos entes federados. Revisitando o histórico de precedentes e a literatura, conclui-se que o STF não alcançou a melhor resposta correta. Assim, três grupos ou blocos de argumentos são utilizados para sustentar a conclusão: a começar com antítese aos fundamentos adotados pelo Supremo como ratio decidendi no paradigma, a passar com a inserção de argumentos relevantes não enfrentados pelo Tribunal e, para finalizar, com a adoção da teoria do direito como integridade de Dworkin. Logo, o Tema merece ser revisto e a sua aplicação automática não pode ocorrer, notadamente caso seja trabalhada a técnica de distinguishing. Com isso, são apresentados 10 argumentos que conduzem à necessidade de revisão do Tema em destaque e, ainda, a sua total inaplicabilidade nas aquisições feitas por entes federados.
