By criminalising managers' excessive risk-taking criminal law enters a sphere which is at the core of the activity it affects. At the same time it provides for criminal punishment for courses of conduct that, without doubt, can be extremely harmful. The objective of this book is to examine existing criminalisation of excessive risk-taking as well as to analyse whether such criminalisation is desirable and if yes, under which conditions.

Das Wirtschaftlichkeitsgebot und mit ihm die zahlreichen weiteren Instrumente zur Umgrenzung des Leistungskatalogs der gesetzlichen Krankenversicherung (GKV) sind für den Erhalt des Solidarsystems von zentraler Bedeutung. Vor allem bei der Arzneimittelversorgung spüren Vertragsärzte den steigenden Kostendruck zunehmend. Unter strafrechtlichen Gesichtspunkten ergeben sich hieraus zwei bedeutsame Fragen: Machen sich Vertragsärzte strafbar, wenn sie Arzneimittel zu Lasten der GKV verordnen, die sie nach sozialrechtlichen Maßstäben nicht hätten verordnen dürfen? Und ist eine Strafbarkeit zu bejahen, wenn Ärzte zwar das Wirtschaftlichkeitsgebot beachten, die Gesundheit des Patienten aber zu Schaden kommt, weil nicht die optimale medizinische Versorgung gewährt wurde? Die Lösung dieser spiegelbildlichen Fragestellungen ist primärer Untersuchungsgegenstand des vorliegenden Werkes. Ferner wird erörtert, ob sich Ärzte strafbar machen, wenn sie für das Verordnen von Arzneimitteln Zuwendungen von der pharmazeutischen Industrie annehmen.
