Die Lehre von den Beweisverboten bildet wohl eine der „Königsdisziplinen“ im Strafprozessrecht und ist seit jeher Gegenstand mannigfaltiger Diskurse in der Rechtswissenschaft und Rechtsprechung. Eher von untergeordneter Bedeutung war bisweilen die Frage der Beweislast im Rahmen der Beweisverbote. Letzteres ist wohl den vermeintlichen Grundsätzen geschuldet, wonach es Beweislastprob-leme im Strafprozess nicht geben könne (Eberhard Schmidt) und Verfahrensfehler durch den Beschuldigten nachgewiesen werden müssen (st. Rspr. des BGH). Es ist festzustellen, dass sich der Be-schuldigte de lege lata hinsichtlich des Vorliegens eines Beweisverbotes mit einer faktischen Beweislast konfrontiert sieht. Ziel dieser Arbeit ist die Schaffung einer dogmatischen Grundlage, die das Zusammenspiel zwischen Beweisverboten und dem Nachweis eines Verfahrensfehlers in einen ent-sprechenden Zusammenhang stellt und von der Rechtsfolgenseite mit einer ausgewogenen Beweislastverteilung aufarbeitet. Die Lösung wird in der Schaffung einer gesetzlichen Grundlage und in einer Beweislastumkehr erblickt.
