The Common Law Tradition

  • Categories: Law

The Common Law Tradition examines the lives and achievements of five individuals who helped broaden the perspectives of the legal academy - Edward H. Levi, Harry Kalven, Jr., Karl Llewellyn, Philip Kurland, and Kenneth Culp Davis - and assesses the extent to which their immediate agendas were realied. What distinguished these men is that their work was practical and rooted in the law, and hence yielded concrete applications. The groups diversity, the tolerant atmosphere in which they taught and wrote, and the attachment of its individual members to empirical approaches differentiate them from todays legal scholars and make their ideas of continuing importance.

An examination of the ethical issues raised by the possibility of human life extension, including its desirability, unequal access, and the threat of overpopulation. Life extension—slowing or halting human aging—is now being taken seriously by many scientists. Although no techniques to slow human aging yet exist, researchers have successfully slowed aging in yeast, mice, and fruit flies, and have determined that humans share aging-related genes with these species. In New Methuselahs, John Davis offers a philosophical discussion of the ethical issues raised by the possibility of human life extension. Why consider these issues now, before human life extension is a reality? Davis points out...

Anticipating a Nuclear Iran

Anticipating a Nuclear Iran

This volume assumes the worst: a defensive, aggressive Iran already possesses a nuclear arsenal. How should the United States handle this threat, and can it deter the use of such weapons? Through three scenario models, this study explores the political, strategic, and operational challenges facing the United States in a post–Cold War world. The authors concentrate on the type of nuclear capability Iran might develop; the conditions under which Iran might resort to threatened or actual weapons use; the extent to which Iran’s military strategy and declaratory policy might embolden Iran and its proxies to pursue more aggressive policies in the region and vis-à-vis the United States; and Iran’s ability to transfer nuclear materials to others within and outside the region, possibly sparking a nuclear cascade. Drawing on recent post–Cold War deterrence theory, the authors consider Iran’s nuclear ambitions as they relate to its foreign policy objectives, domestic politics, and role in the Islamic world, and they suggest specific approaches to improve U.S. defense and deterrence planning.
