The ASEAN Community

This report, the first in the ASEAN Studies Centre report series, begins with a brief account of the important points raised during the discussions made at the workshop on "The ASEAN Community: Unblocking the Roadblocks," organized by the ASEAN Studies Centre and the Regional Economic Studies Programme on 15 April 2008. The first endeavour in which the new ASEAN Studies Centre was actively involved, the closed-door workshop gathered Southeast Asian experts on ASEAN for what was essentially a brainstorming session on the nature of the ASEAN Community that the association aspires to be, segmented into its three pillars - the ASEAN Economic Community, the ASEAN Security Community, and the ASEAN...

ASEAN

With the completion of the ASEAN Charter, ASEAN needs to fully appreciate and work out the issues connected with its implementation. It is also important for ASEAN and its business sector to understand and implement the two newly completed key integration instruments (the ASEAN Trade in Goods Agreement and the ASEAN Comprehensive Investment Agreement 2009) and the business enhancing initiatives envisaged under them. Both areas of work have taken on added urgency in view of ASEAN's goal of putting in place an ASEAN Economic Community by 2015. This is the first book which examines both the above issues, the problems related to them and possible solutions. "Mr Tiwari is a legal authority on ASE...

Between Market Economy and State Capitalism

  • Categories: Law

One major issue facing the world trading system today is how to deal with the challenge of China's state capitalism. Many commentators believe that the existing WTO rules are insufficient and, thus new rules are needed. This book challenges this conventional wisdom. Through meticulous studies and fresh analysis of the commitments in China's WTO accession package, existing rules on state capitalism in WTO agreements and recent attempts to make new rules on these issues at the bilateral, regional and multilateral levels, this book argues that existing WTO rules, especially those on subsidies, coupled with China-specific rules in its accession protocol, do provide feasible tools to counter China's state capitalism. This book also discusses the reasons for the lack of usage of these rules and provides concrete policy suggestions on how the rules may be better utilized, as well as how to conduct constructive negotiations on new rules in the WTO and beyond.

How does the hybrid nature of SWFs affect the application of state immunity to these funds? May an SWF be sued in foreign courts for wrongful acts committed in the course of its investment activities? Can SWF investments be attached by a private creditor seeking to enforce an investment arbitration award against the fund’s state of nationality? This monograph addresses these questions from the perspective of the 2004 New York Convention and six selected jurisdictions (US, UK, France, Germany, Italy, China), with the broader aim of highlighting potential new standards for implementation of the state immunity rule to SWFs.
