Autonomy

Autonomy arrangements have gradually become more numerous, & different developments in respect of autonomy can be discerned in the fields of international & domestic law. The patterns of autonomy are quite disparate, but because various fields of law treat autonomy in different ways, it is fruitful to inquire into the applications of autonomy & to ask what autonomy as such implies. Autonomy is a multi-faceted phenomenon which on the one hand contains the issue of devolution or decentralization of law-making or other normative powers in the institutional fabric of the country without any minority protection component; on the other hand it may in addition contain an explicit minority protection component designed to offer special protection to minority groups in society. Especially in the latter sense, the issue of effective participation of a minority in the government is an important issue, & in this respect, there is a connection between autonomy & a general understanding of democracy.

Bilingual Higher Education in the Legal Context

  • Categories: Law

This book is devoted to complex questions of building and developing legal education in more than one language, through two state languages (French and Dutch in Belgium, German and French in Switzerland, English and French in Canada, Finnish and Swedish in Finland) and/or through the medium of minority or lesser used languages (Basque, Galician, Catalan, Welsh, Romanian). Some states have a long and well-established tradition of bilingual legal education; others have only recently started to develop a legal education system through non-dominant languages; finally, in some other cases only partial bilingual legal education obtains, rather than a fuller model. The volume purports to examine best practices and to draw useful lessons from the experiences of other bilingual societies.

The Nordic Self-Governing Areas in a Peace Perspective

The Nordic Region has enjoyed two centuries of peaceful co-existence that are worth highlighting and learning from. As a result, the Nordic autonomous regions have attracted considerable attention in recent years. There is significant international interest in their experiences, including their experience of territorial autonomy. In a world that appears increasingly troubling, the autonomy of the Faroe Islands, Greenland, and Åland is worth studying from the perspective of conflict resolution. It seems important to examine the marked development that these autonomous regions have undergone and the success they have had in finding solutions to the conflicts that have arisen – not just from a Nordic perspective, but also from a wider international point of view. The conclusions of a comparative study of the autonomous regions’ legal, economic, and security policy developments are presented here. The complete study can be ordered from The Åland Islands Peace Institute at www.peace.ax

This study examines two important questions regarding terrorism and political violence: which threats to human security constitute root causes for collective violence and which adequate responses for these root causes are available to the international community. The responses are examined on the basis of international law, in particular human rights law, and within the concept of human security, with the goal of fostering a long-term reduction in political violence. Drawing on existing political discussions and research about the root causes of terrorism, Zwitter develops a legal framework for the application of legal terrorism prevention tools. This study serves as a framework of action an...

The Rule of Law and Automated Decision-Making

  • Categories: Law

The book presents observations concerning automated decision-making from a general point of view at the same time as it analyses the manner in which praxis in some jurisdictions has evolved as concerns automated decision-making and how the requirements that are placed by the legal orders on it are formulated. The principle of the rule of law should apply in the context of automated decision-making of public authorities just as much as when the decision-makers are physical persons. In sync with increasing automatization of decision-making in public authorities, problematizing questions about the appropriate legal basis for algorithmic decision-making have started emerge. How should the princi...

Surpassing the Sovereign State

'Surpassing the Sovereign State' shows that in regions throughout the world partially independent territories (including Hong Kong, Cayman Islands, Kurdistan, New Caledonia, and others) tend to be wealthier and more secure than sovereign states. This book explains how these polities emerge, maintain themselves, and sometimes come to an end.
