O contraditório no participativo no processo penal
O objetivo desta obra é realizar uma análise do princípio do contraditório participativo no processo penal, com ênfase na fase pré-processual. O CPC/2015, ao incorporar a devida constitucionalização do processo em seu bojo, bem como ao estabelecer as normas fundamentais do processo, fez renascer o processo civil, mas também lançou luz sobre o processo penal, conferindo-lhe uma sobrevida democrática até que seja editado um novo código. Nesse sentido, o atual CPP, promulgado em 1940, atravessou várias gerações e foi mutilado pelas sucessivas reformas, evocando a imagem de uma Quimera. Assim, imperiosa a utilização da teoria do diálogo das fontes, ressaltando-se, ainda, o pleno reconhecimento da aplicação supletiva e subsidiária do CPC ao processo penal na jurisprudência dos Tribunais Superiores, reiterada no recente enunciado 3 da I Jornada de Processo Civil do CJF (cuja proposição teve lastro na presente obra). Uma boa leitura, e que esta seja coroada por muitas reflexões!
