Reclaiming the Petition Clause

  • Categories: Law

Since the 2004 presidential campaign, when the Bush presidential advance team prevented anyone who seemed unsympathetic to their candidate from attending his ostensibly public appearances, it has become commonplace for law enforcement officers and political event sponsors to classify ordinary expressions of dissent as security threats and to try to keep officeholders as far removed from possible protest as they can. Thus without formally limiting free speech the government places arbitrary restrictions on how, when, and where such speech may occur.

A series of studies explores the political contexts of petitioning, the broad geographical and social range of petitioners, and the fascinating worm's-eye view of medieval life tha...

Democracy by Petition

This pioneering work of political history recovers the central and largely forgotten role that petitioning played in the formative years of North American democracy. Known as the age of democracy, the nineteenth century witnessed the extension of the franchise and the rise of party politics. As Daniel Carpenter shows, however, democracy in America emerged not merely through elections and parties, but through the transformation of an ancient political tool: the petition. A statement of grievance accompanied by a list of signatures, the petition afforded women and men excluded from formal politics the chance to make their voices heard and to reshape the landscape of political possibility. Demo...

This unique study presents the results of a cross-national analysis of citizenship and participation among citizens in twelve European democracies. Research on the future and quality of contemporary democracy is usually restricted to focus either on political participation, on particular aspects of citizenship, or on social activities, exclusively. This new book offers the first empirical investigation of the relationships both between social and political involvement, and between ‘small-scale’ and ‘large-scale’ democracies. Citizenship and Involvement in European Democracies offers representative samples of the populations in a selection of European countries between 2000-2002, incl...
