The papers in this collection are drawn from the annual The Supreme Court Review, which, since its inception in 1960, has been regarded by such legal scholars as Robert F. Drinnan, S. J., as "An indispensable, universally quoted work of the highest scholarship regarding the world's most influential tribunal." Now some of the most important contributions to the Review have been brought together in paperback editions that focus on issues that are becoming increasingly relevant to the ordinary citizen's daily life.

There are few issues as controversial as where to draw the line between church and state. The framers of the Constitution's Bill of Rights began their blueprint for freedom by drawing exactly such a line. Th e fi rst clauses of the First Amendment provide: "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof." Th e justices of the Supreme Court have not been wanting for advice from self-appointed guardians. Th e diffi culty with such advice is that the contestants are more convincing when they criticize their opponents' interpretations than when they seek to establish the validity of their own.

Mr. Justice Murphy

  • Categories: Law

In less than a decade Frank Murphy rose from Mayor of depression-torn Detroit to Governor General and High Commissioner of the Philippines, Governor of Michigan, Attorney General of the United States, and one of the most libertarian Supreme Court Justices in American history. Professor Howard bases his biography of this colorful Irish New Dealer extensively on the recently opened private papers of Justice Murphy, the papers of Franklin D. Roosevelt, Harlan F. Stone, Harold Burton, and Felix Frankfurter. Mr. Justice Murphy is a fascinating look at the interplay of high office and personality. Originally published in 1968.
