Defining Civil and Political Rights provides a comprehensive analysis and commentary on the decisions - technically known as views - of the United Nations Human Rights Committee, for use by human rights lawyers throughout the world. Each of the substantive rights and freedoms set out in the International Covenant on Civil and Political Rights is considered in detail, by analysis of final reviews and comments of the Human Rights Committee. This second edition has been thoroughly revised and updated to take account of recent jurisprudence on the Human Rights Committee. New material has been added based upon substantive areas of the committee's jurisprudence.

The European Union, International Law and the Promotion and Protection of Democracy

This book provides a study of the role played by international organizations in the advancement of democracy as a principle of international law. Since the end of the Cold War, democracy has emerged as a substantial legal principle in international relations. A particular area where democracy is prominent as a legal obligation can be found in criteria for membership to a number of international organizations. In the EU, democracy is a treaty-based obligation for all current Member States and is also used for assessing the appropriateness of future Member States. In this regard, the EU has played a major role in developing the scope and extent of democracy as a legal principle and in developi...

International Conflict and Security Law

  • Categories: Law

Hilaire McCoubrey wrote extensively in the area of armed conflict law, and on the issues of collective security law and the law relating to arms control. Although he died at the early age of 46 in 2000 he had contributed significantly to the separate study of these areas, but also to the idea of studying the issues as a whole subject. The collection covers difficult and controversial issues in the area of conflict and security law. The contributors, drawn both from academe and practice, provide expert analysis of many aspects of the law governing armed conflict and collective security. As well as providing a fitting tribute to the main aspects of Hilaire's contribution to knowledge, the volume provides a coherent reconsideration and development of key aspects of conflict and security law at a time when that law is being applied, breached, debated or reformed on almost a daily basis.

Constructions of Terrorism

"Discussions about the meaning of terrorism are enduring in everyday language, government policy, news reporting and international politics. Disagreements about both the definition and the class of violent events that constitute terrorism contribute to the difficulty of formulating effective responses aimed at the prevention and management of the threat of terrorism and the development of counterterrorism policies. This collection makes a major contribution to understanding terrorism through the inter-disciplinary perspectives through which the contributors confront the problem"--Provided by publisher.

Humanitarian Occupation

This book analyzes a new phenomenon in international law: international organizations assuming the powers of a national government in order to reform political institutions. After reviewing the history of internationalized territories, this book asks two questions about these 'humanitarian occupations'. First, why did they occur? The book argues that the missions were part of a larger trend in international law to maintain existing states and their populations. The only way this could occur in these territories, which had all seen violent internal conflict, was for international administrators to take charge. Second, what is the legal justification for the missions? The book examines each of the existing justifications and finds them wanting. A new foundation is needed, one that takes account of the missions' authorisation by the UN Security Council and their pursuit of goals widely supported in the international community.
