Nachhaltige öffentliche Beschaffung
Das totalrevidierte Bundesgesetz über das öffentliche Beschaffungswesen (BöB), das am 1. Januar 2021 in Kraft getreten ist, stärkt den Qualitätswettbewerb gegenüber dem Preiswettbewerb. Ein zentraler Bestandteil des Qualitätsverständnisses ist die Nachhaltigkeit nach wirtschaftlichen, ökologischen und sozialen Gesichtspunkten. In der EU hat die Berücksichtigung der Nachhaltigkeit zu wegweisender Rechtsprechung des EuGH geführt und wurde 2014 in den massgebenden Richtlinien geregelt. Dieses Buch vergleicht die Vorgaben und den Spielraum, den das EU-Beschaffungsrecht für die Berücksichtigung der Nachhaltigkeit setzt, mit dem neuen BöB. Die Autoren zeigen auf, welche Erkenntnisse aus dem EU-Recht für die Auslegung des schweizerischen Vergaberechts relevant sind. Ausserdem geben sie konkrete Hinweise zur Berücksichtigung von Nachhaltigkeit im Vergabeverfahren.
