This volume offers insights into the major Jewish migration movements and rebuilding of European Jewish communities in the mid-twentieth century. Its chapters illustrate many facets of the Jews’ often traumatic post-war experiences. People had to find their way when returning to their countries of origin or starting from scratch in a new land. Their experiences and hardships from country to country and from one community of migrants to another are analyzed here. The mass exodus of Jews from Arab and Muslim countries is also addressed to provide a necessary and broader insight into how those challenges were met, as both migrations were a result of persecution, as well as discrimination.

This book focuses on the interaction and mutual influences between the East and the West in terms of their legal systems and practices. In this regard, it highlights Professor Herbert H.P. Ma’s achievements and his efforts to bring Eastern and Western legal concepts and systems closer together. The book shows that, while there have been convergences between different legal regimes in many fields of law, diverse legal practices and approaches rooted in differing cultural, social, political and philosophical backgrounds do remain, and that these differences are not necessarily negative elements in the contemporary legal order. By examining different levels of the legal order, including domes...

Hadrian's Echo

A brilliant demolition of the standard pretence that anti-Zionism is about frustration with Israel's treatment of the Palestinians rather than an obsessive fixation with the Jewish state. Efraim Karsh - Director, Middle East Forum & Research Professor of Middle East and Mediterranean Studies, King's College London I recommend Hadrian's Echo to anyone who wants to understand the phenomenon of Israel-bashing - Professor Gerald M. Steinberg, Bar Ilan University and Executive Director of NGO Monitor Guidance from the Bench You of all people, jury members, may not blindly assume that a law professor who forsakes varsity gown and corridors and decamps to Palestine packs his scholarly habits. You m...

Comparative Recognition and Enforcement

  • Categories: Law

This book provides the first detailed analysis of recognition and enforcement of foreign judgments and awards in civil and commercial matters from a transnational perspective. This perspective facilitates greater understanding of the present state of recognition and enforcement and offers insight into the establishment and operation of key modern instruments. This book represents a timely contribution, as instruments harmonising and promoting recognition and enforcement are increasingly being considered and implemented internationally. Many countries have recently reiterated their commitment to improving access to justice and have indicated an intention to sign one or both of the treaties designed to harmonise and promote recognition and enforcement of civil and commercial judgments internationally: the 2005 Choice of Court Convention or the 2019 Judgments Convention. This book is an essential resource for policymakers, scholars, and intergovernmental organisations to understand the nature and origin of recognition and enforcement approaches, as well as their application, interpretation, and future directions.

Analysis of Britain’s role in Palestine has proceeded on the assumption that Britain was lawfully in control of the territory. Analysts differ on whether what it did was proper, but they agree that Britain had a lawful mandate and that through the League of Nations, and that the international community advocated for Jewish territorial rights in Palestine. This analysis, though widely shared, is incorrect. Britain had no territorial rights itself to govern Palestine. It was there by dint of force of arms. The mandate it had over Palestine was initiated unilaterally. The mandate was not given to Britain by the League of Nations. The League of Nations had no authority over Palestine and, in particular, nothing it could give to Britain. The document that Britain composed for the governance of Palestine was never approved by the League of Nations. When, in 1947, Britain had to explain the United Nations its legal status in Palestine, it resorted to distorting the historical facts, in an effort to make it appear it had been in Palestine lawfully.
