Unterschiede gibt es gleichwohl, so hinsichtlich positiver wie negativer Generalpravention in der Strafzumessung im Allgemeinen und bezuglich der Abschreckungspravention im Speziellen. In Deutschland unter strengen Voraussetzungen bei der Begrundung der Strafhohe zugelassen, ist die Abschreckungspravention in Polen schlechthin verboten.
