The International Law Commission's Draft Conclusions on Peremptory Norms
In 2022, the ILC adopted the Draft Conclusions on Peremptory Norms of General International Law. The text of the Draft Conclusions consists of twenty-three Draft Conclusions and addresses two aspects: the identification of peremptory norms and their legal consequences. Attached to the Draft Conclusions is an Annex with a non-exhaustive list of jus cogens norms previously identified by the Commission. The International Law Commission's Draft Conclusions on Peremptory Norms serves, in part, as a commentary on the ILC's work and provides a broader understanding of the Draft Conclusions from the perspective of an insider. The book goes beyond a commentary, however, as it provides an analysis and evaluation of the broader legal issues raised by the Draft Conclusions. Relying inter alia on the discussions within the Commission and the doctrinal debate surrounding the concepts covered, the book will not only offer explanation of what is addressed in the Draft Conclusions but also an assessment of the choices made by the Commission and the consequences of those choices.
La función consultiva de la Corte Interamericana de Derechos Humanos
La función consultiva de la Corte Interamericana de Derechos Humanos es un estudio de las veintiuna opiniones consultivas emitidas por la Corte Interamericana hasta el año 2014 que no tiene parangón en la literatura jurídica del sistema interamericano. El texto está construido sobre tres ejes: la caracterización normativa de la función consultiva; la descripción de la práctica consultiva de la Corte; y las implicaciones del divorcio entre la norma y la práctica consultiva, caracterizado en lo que el autor llama las “fisuras de la función consultiva”: la extensión de la competencia y la indeterminación de sus efectos. Jorge Roa demuestra cómo la práctica de la Corte Interamericana, concretada en estas dos fisuras, ha conducido al deterioro de la seguridad jurídica internacional y a una pérdida relativa de la autoridad de la Corte, y señala, con razón, la urgencia de un cambio de rumbo en la materia. Writing Madness, Writing Normalcy
What does it mean to be "mad" in contemporary American society? How do we categorize people's reactions to extreme pressures, trauma, loneliness and serious mental illness? Importantly--who gets to determine these classifications, and why? This book seeks to answer these questions through studying an increasingly popular media genre--memoirs of people with mental illnesses. Memoirs, like the ones examined in this book, often respond to stigmatizing tropes about "the mad" in popular culture and engage with concepts in mental health activism and research. This study breaks new academic ground and argues that the featured texts rethink the possibilities of community building and stigma politics. Drawing on literary analysis and sociological concepts, it understands these memoirs as complex, at times even contradictory, approaches to activism.
