In The Human Right to Water in Latin America, Anna Berti Suman investigates the development of the right to water and of water law in the Latin American context. By examining the significance of Latin American constitutional evolution, doctrine, and jurisprudence, the author illustrates the Latin American contribution in stimulating the social, political, and economic debate on the right to water, regionally and worldwide. Through an overview on the right to water in Latin American constitutions and of the main Latin American water management systems, Suman argues that an analysis of the right to water has to take account of its application in specific contexts. The intrinsic connection between the right to water and the role of the private sector is examined through topical insights into the highly privatized Chilean water services. In the conclusion, the relevance of the lessons learnt from the Latin American experience for the global debate on the right to water is convincingly proved.

This publication examines issues of water sector reform and performance from the perspectives of institutional economics and political economic studies. The authors develop an alternative quantitative assessment methodology based on the principle of 'institutional ecology', as well as data collected from 127 water experts from 43 countries and regions around the world using a cross-country review of recent water sector reforms within an institutional transaction cost framework.

The election of Michelle Bachelet as president of Chile in 2006 gave new impetus to the struggle in that country for legislation to improve women’s rights and highlighted a process that had already been under way for some time. In Feminist Policymaking in Chile, Liesl Haas investigates the efforts of Chilean feminists to win policy reforms on a broad range of gender equity issues—from labor and marriage laws, to educational opportunities, to health and reproductive rights. Between 1990 and 2008, sixty-three bills were put forward in the Chilean legislature as a result of pressure brought by the feminist movement and its allies. Haas examines all these bills, identifying the conditions under which feminist policymaking was most likely to succeed. In doing so, she develops a predictive theory of policy success that is broadly applicable to other Latin American countries.
Nella ricorrenza dei cinquant’anni dalla scomparsa di Emilio Betti, l’Istituto che porta il suo nome ha voluto ricordare il giurista promovendo un incontro di studi incentrato sul tema dell’interpretazione che, fra i tanti sui quali Betti ha lavorato, è certo quello sul quale più intensamente si fermò a riflettere durante gli ultimi anni della sua vicenda intellettuale. Questo volume raccoglie molti dei contributi che arricchirono quell’incontro assieme ad altri che si sono aggiunti successivamente. Betti, com’è noto, costruì una peculiare teoria dell’interpretazione capace di uscire dallo stretto ambito giuridico per assumere valenza generale. Il taglio fortemente interdisciplinare che si è voluto dare all’incontro ha consentito di ricostruire il lungo percorso intellettuale che ha preparato l’elaborazione della sua costruzione (e quindi i vivaci dialoghi con personaggi come Croce, Capograssi e Gadamer); di estendere l’indagine sui molteplici piani toccati dall’ermeneutica bettiana; di indagare le ragioni della fortuna tutto sommato limitata che la sua teoria ha incontrato a livello internazionale. En estas páginas, mediante breves artículos de doctrina o comentarios a decisiones legales o jurisprudenciales, el autor expone el perfil del derecho neomoderno y sus expresiones. En ese marco, destaca el rol del jurista, como observador social y también como generador de ciencia jurídica, en la discusión de muy diversas materias de relevancia pública. Se sitúan allí –entre muchas otras materias– la debida atención a las fuentes del derecho democrático, el resguardo de la corrección en los procesos legislativos, la atención a la jurisprudencia y a los principios que ésta crea, la conducta de los juristas en una sociedad democrática y el fomento a una sana circulación de ideas en los debates jurídicos. En ese marco, este libro se inscribe como un aporte relevante a la comprensión de los nuevos paradigmas jurídicos.
