O livro tem o objetivo de trazer à reflexão a forma como os fenômenos psíquicos inconscientes interferem na relação processual e destacar que o sistema jurídico e a ciência jurídica desconsideram a interferência da base inconsciente no direito. A constatação, pelas ciências da mente, da intensidade e importância do inconsciente na atividade humana e a detecção de que o direito possui, em sua essência, afetação inconsciente na sua constituição, interpretação e transformação, faz com que não se possa desconsiderar a intensa relação entre o inconsciente e a atividade jurídica. Partindo-se das mais recorrentes teorias psicanalíticas sobre o inconsciente do referencial teórico de Antonio Damásio e Jacques Lacan, buscou-se atrelar o processo e aspectos inconscientes. Os resultados obtidos com a obra revelam que, não obstante a relação jurídica processual seja vigorosamente impactada por elementos inconscientes, não há, nas ciências jurídicas ou no próprio sistema jurídico, ferramentas capazes de traduzir a relevância dessa interferência, o que repercute na falta de efetividade na obtenção da prestação jurisdicional.
