European Developments in Corporate Criminal Liability

  • Categories: Law

When corporations carry on their business in a grossly negligent manner, or take a cavalier approach to risk management, the consequences can be catastrophic. The harm may be financial, as occurred when such well-regarded companies as Enron, Lehman Brothers, Worldcom and Barings collapsed, or it may be environmental, as illustrated most recently by the Gulf oil spill. Sometimes deaths and serious injuries on a mass scale occur, as in the Bhopal gas disaster, the Chernobyl nuclear explosion, the Paris crash of the Concorde, the capsize of the Herald of Free Enterprise, and rail crashes at Southall, Paddington and Hatfield in England. What role can the law play in preventing such debacles and i...

Art, Religion and Resistance in (Post-)Communist Romania

Art, Religion and Resistance in (Post-)Communist Romania

This book illuminates the interconnections between politics and religion through the lens of artistic production, exploring how art inspired by religion functioned as a form of resistance, directed against both Romanian national communism (1960-1989) and, latterly, consumerist society and its global market. It investigates the critical, tactical and subversive employments of religious motifs and themes in contemporary art pieces that confront the religious ‘affair’ in post-communist Romania. In doing so, it addresses a key gap in previous scholarship, which has paid little attention to the relationship between religious art and political resistance in communist Central and South-East Europe.

Negotiated Justice and Corporate Crime

This book argues that there is a strong normative argument for using the criminal law as a primary response to corporate crime. In practice, however, corporate crimes are rarely dealt with through criminal sanctioning mechanisms. Rather, the preference – for both prosecutors and corporates – appears to be on negotiating out of the criminal process. Reflecting this emphasis on negotiation, this book examines the use of Civil Recovery Orders and Deferred Prosecution Agreements as responses to corporate crime, and discusses a variety of UK case studies. Drawing upon legal and criminological backgrounds, and with an emphasis on the conceptual frameworks of ‘negotiated justice’ and ‘legitimacy’, the authors examine the law, policy and practice of these enforcement responses. They offer an original, theoretically-informed analysis which is accessible to practitioners and researchers.

Corporate Liability and International Criminal Law

  • Categories: Law

This book investigates whether corporate criminal liability should be incorporated within the scope of international criminal law. The work provides unique insight into the evolution of the debate on the international criminal liability of corporations to facilitate future discussion on the possibility of including corporations within the scope of international criminal law. It combines a detailed examination of Nuremberg and Rome with the examination of previously overlooked initiatives such as the Draft Code of Offences against Peace and Security of Mankind and the 1951 and 1953 Committees on International Criminal Jurisdiction. This analysis is also complemented by a review of significant...

This book presents a selection of articles with focus on the theoretical foundations of business ethics, and in particular on the philosophy of management and on human rights and business. This implies identifying and discussing conflicts as well as agreement with regard to the philosophical and other foundations of business and management. Despite the general interest in corporate social responsibility and business ethics, the contemporary discussion rarely touches upon the normative core and philosophical foundations of business. There is a need to discuss the theoretical basis of business ethics and of business and human rights. Even though the actions and activities of business may be di...

A collection written by a who's who of antifascist researchers and theorists in the US, including Tal Lavin (Culture Warlords); Kim Kelly (Fight Like Hell), Hilary Moore (No Fascist USA!), and Daryle Lamont Jenkins (One People's Project). ¡No Pasarán! is an anthology of antifascist writing that takes up the fight against white supremacy and the far-right from multiple angles. From the history of antifascism to today's movement to identify, deplatform, and confront the right, and the ways an insurgent fascism is growing within capitalist democracies, a myriad of voices come together to shape the new face of antifascism in a moment of social and political flux.
