Analisa-se também os fatores juridicamente determinantes que embasam a ideia de um órgão central administrativo com poder normativo primário para regular matéria processual em benefício da eficiência e do aprimoramento da tutela jurisdicional, verificando-se a vocação do Conselho Nacional de Justiça, e da administração da justiça como um todo, para a gestão da competência nos tribunais, inclusive como ferramenta de solução para conflito de competência no processo coletivo.
