"The book is concerned not just with 'formal' or legal citizenship, but also with the related development of political participation, economic privileges and social rights. Fahrmeir argues that rather than being separate facets of one 'citizenship', these elements were (and continue to be) available to groups that only partly coincide with the community of legal citizens. And he considers whether the combined effects of regionalism, European unification, 'post-democracy' and economic globalization are eroding state citizenship or whether increased immigration controls and stringent criteria for nationality render it as relevant today as ever."--Jacket.

Migration Control in the North Atlantic World

  • Categories: Law

The migration movements of the 20th century have led to an increased interest in similarly dramatic population changes in the preceding century. The contributors to this volume - legal scholars, sociologists, political scientist and historians - focus on migration control in the 19th century, concentrating on three areas in particular: the impact of the French Revolution on the development of modern citizenship laws and on the development of new forms of migration control in France and elsewhere; the theory and practice of migration control in various European states is examined, focusing on the control of paupers, emigrants and "ordinary" travelers as well as on the interrelationship between the different administrative levels - local, regional and national - at which migration control was exercised. Finally, on the development of migration control in two countries of immigration: the United States and France. Taken altogether, these essays demonstrate conclusively that the image of the 19th century as a liberal era during which migration was unaffected by state intervention is untenable and in serious need of revision.

Citizens Into Dishonored Felons

Over the course of its history, the German Empire increasingly withheld basic rights—such as joining the army, holding public office, and even voting—as a form of legal punishment. Dishonored offenders were often stigmatized in both formal and informal ways, as their convictions shaped how they were treated in prisons, their position in the labour market, and their access to rehabilitative resources. With a focus on Imperial Germany’s criminal policies and their afterlives in the Weimar era, Citizens into Dishonored Felons demonstrates how criminal punishment was never solely a disciplinary measure, but that it reflected a national moral compass that authorities used to dictate the rights to citizenship, honour and trust.

Annual of German and European Law

  • Categories: Law

German law has been of long-standing interest and increasing relevance around the world, but access for researchers and practitioners very frequently was limited by the necessity of German language proficiency. Offering English-language access to these fields, the Annual of German & European Law is a significant contribution to the global discourse on and study of German, European and Comparative law. Each volume presents: (1) articles - original, cutting-edge scholarship from the fields of German and European law; (2) jurisdictional reports - comments on the latest caselaw from Germany's most significant courts and the case-law of the European courts having importance for Germany; (3) book ...

The Transformation of Foreign Policy

The study of foreign policy is usually concerned with the interaction of states, and thus with governance structures which emerged either with the so-called 'Westphalian system' or in the course of the 18th century: diplomacy and international law. As a result, examining foreign policy in earlier periods involves conceptual and terminological difficulties, which echo current debates on 'post-national' foreign policy actors like the European Union or global cities. This volume argues that a novel understanding of what constitutes foreign policy may offer a way out of this problem. It considers foreign policy as the outcome of processes that make some boundaries different from others, and set ...

The Politics of Military Force

The Politics of Military Force examines the dynamics of discursive change that made participation in military operations possible against the background of German antimilitarist culture. Once considered a strict taboo, so-called out-of-area operations have now become widely considered by German policymakers to be without alternative. The book argues that an understanding of how certain policies are made possible (in this case, military operations abroad and force transformation), one needs to focus on processes of discursive change that result in different policy options appearing rational, appropriate, feasible, or even self-evident. Drawing on Essex School discourse theory, the book develo...
