Anotando as normas do novo regime jurídico da concorrência, aprovado pela Lei n.o 19/2012, de 8 de maio, esta obra procura contribuir para uma melhor apreensão prática da aplicação e extensão de tais regras, muito assentes no já longo acervo decisório que o direito da concorrência tem em Portugal e a que aqui se confere lugar de destaque. This report looks at efforts by Portugal’s Court of Auditors (Tribunal de Contas, TdC) to make better use of data and analytics in assessing risks in public procurement. It identifies key financial and non-financial risks to refine the TdC’s audit selection process and increase the effectiveness and efficiency of the public procurement system. The report provides recommendations for improving and maintaining data-driven risk assessments that align with the TdC’s Digital Transformation Strategy. The report also includes a data-mapping exercise and data reliability assessment in preparation for the next phase of the project, which includes developing a working model to detect procurement risks and irregularities using real-world data.
O presente estudo versa sobre a influência do Direito da União Europeia no Direito Nacional da Concorrência, com especial destaque para a sua componente contraordenacional. São analisados aspetos de responsabilidade empresarial, cumprimento normativo e aplicação da coima em que se verifica um menor alinhamento entre as leis, as orientações, a prática decisória e a jurisprudência da União Europeia, de um lado, e os equivalentes nacionais, do outro. Em especial, é apresentada uma reflexão crítica sobre a imputação da responsabilidade empresarial e a imputação da coima. Quanto à imputação da coima, a fórmula de cálculo da coima é analisada em pormenor.

This book, adopting a multidisciplinary approach, investigates the definition of autonomous work and the kind of protection it receives and should receive in a global perspective. The book advocates for the existence of genuine autonomous work to be distinguished from employment and false self-employment. It deserves specific attention from legislators in the view of removing any obstacles to the exercise of freedom of association and collective action at large. The book is divided into two parts. The first focuses on the evolving notion of autonomy and its consequences on social protection, offering a theoretical frame from an organizational, political and legal point of view. The second aims at discovering new regulatory and protective horizons for autonomous work, in the light of blockchain, platform work, EU Competition Law, social security and liberal professions. Finally, the authors offer insights and recommendations on how to protect work beyond categories.
The emergence of sharing mobility is having a profound impact on urban landscapes. In fact, it is deeply affecting the traditional organization of local services by calling into question how urban transportation is planned, and by redesigning city spaces. Further, by connecting people to shared assets, services or both, sharing mobility is poised to facilitate the more efficient use of underutilized resources, becoming a powerful tool for economic growth and social inclusion, while also contributing to sustainability. That being said, the economic, social and spatial impacts of sharing mobility have not been sufficiently investigated, and so far, the evidence is mixed. From a normative standpoint, while it is relevant to better understand the relations between sharing mobility, the city and the environment, it is also of crucial importance to define new policies and sound rules for sharing mobility in urban areas. Against this backdrop, this book adopts a multidisciplinary perspective to explore the role that sharing mobility can play in the creation of more just and sustainable cities.
